Child Support

My husband is paying child support for two children. His previous wife has primary custody but the children live with her mother. We have the two children every other weekend. We had the child support payments transferred to her mother, which made the previous wife very angry. She has since remarried and basically has very little to do with her children. She is a stay at home wife with only the income from her new husband. Can we open a Domestic Relations case to have her pay for some of this child support instead of all financial responsibility being solely my husbands.

If a party has no income the courts can and do impute an income based on education and experience. If the court did, your husband's support obligation should be reduced. I offer free consultations.
