Legal Question in Family Law in Pennsylvania

Civil marriage annulment

I would like to get a civil marriage that lasted 15 months annuled. We were both living in Pennsylvania at the time of the marriage but went to Elkton, Maryland to get married. Please advise how I would go about getting this done and what would the scenario be just in case my ex husband is deceased. Thank you.

Re: Civil marriage annulment

When two people are married in the eyes of the law, the proper procedure is to obtain a divorce from the courts. In Pennsylvania, there is no fault divorce. Neither party has to prove that the other is at fault and the same can be obtained by consent or after separation for 2 years. The length of the marriage is irrelevant.

Annulment would only be considered if the marriage was not legal to begin with. In that event, the court would be declaring that the marriage was null and void. There would be no need to obtain a divorce because you were never legally married to begin with.

I trust this has been helpful, but feel free to call or e-mail with any questions on a free intial basis.
