Legal Question in Family Law in Pennsylvania

custody/visitation of son

My husband and I have not been together for several months. I gave birth to our son two weeks ago. I have not invited my husband to come see him. I am afraid of my husband and the hospital helped to make sure he didnt' come into the hospital during delivery due to domestic violence issues.

I know my husband is macho and is going to want to show off his son. Since we are married I am sure he can see him whenever he wants.

How will he force his way to see him? I mean will I be summoned to court since although I have not told him to come see him I have not asked him too. He is telling people I won't let him come.

Will he go to domestic relations? I am on pins and needles wondering when I will get some type of certified letter about custody/visitation or whatever.

He will be able to ask the court to order you to allow him to see your son; however if he did subject you to violence you should pursue a protective order. Depending on his acts you will also have the opportunity to limit the contact in a way that will give you & your son some protection. The limitations will depend upon the circumstances of your case. He does not have the absolute right to see his son on demand. You are not violating any law by refusing to arrange contact due to his violent nature. There are no guarantees; but the court will be generally sympathetic to your situation.
