Legal Question in Family Law in Pennsylvania
Divorce and Inheritance
When I got married 27 years ago, my husband moved into my home that I had inherited after my parents passed away. We soon sold it, moved on. My husband and I are divorcing. I will not have any inheritance to split during my divorce. His parents are in their 80's in ill health with a huge inheritance coming to my husband. I read that I should get part of this in the settlement. My attorney disagrees. Am I right or is he? How can I insure benefiting from this situation?

Re: Divorce and Inheritance
Your attorney is correct that the inheritance of your husband is not marital property subject to distribution. However, you can attempt to negotiate something with your husband that will benefit you. Suggest you develop a stragegy with your attorney on this issue. It is impossible to evaluate your situation based on the limited information you have supplied in your question. Good luck.
