Legal Question in Family Law in Pennsylvania

I want to file my taxes under "married but filing separately" as I am getting divorced.

We have 2 kids & last year I did not make enough $ to earn child tax credit. If he claims them for this purpose, could it in any way effect future custody??

Not really. What matters is who really has custody of the children.
