Legal Question in Family Law in Pennsylvania

My husband bought our house and is on the mortgage -- I didn't sign any papers. We have two children who need to remain in the school system in Montgomery Township (Lansdale). What are my rights in terms of him not taking the home.

These days, it doesn't matter *whose* name is on the deed/mortgage: if you lived somewhere together as husband and wife, that place is considered the marital home and the court will decide what happens with it. If you are still there with the children, he cannot put you out without court approval -- and you could file a motion with the court for (at least) temporary possession of the marital home in the meantime. Hope this information helps.

All of these questions and more can be addressed when you sit down with an experienced family law attorney to discuss your situation. If you haven't done so yet, now is probably the time.

Best of luck to you and your kids. If you'd like to discuss your situation offsite, feel free to contact me directly -- I'm just north of you in Souderton.
