Kicking Daughter Out Of House

My mother in law wants to kick out her daughter and her two kids (age 3) out of her home, she is verbally abusive, doesnt follow the rules of her home. The daughter does not pay rent, is not on her deed or mortgage. The daughter moved in approx. 1 1/2 yrs ago for what was suppose to be for a few months just to get back on her feet. My mother in law is sick and cannot take her bing disredpectful lease help in finding out how she can get her out of the house

Finding yourself unable to help your own children is always a very difficult thing. It is very hard on every mother, but she is not 'superwoman' and must also protect her health.

The legal part is very simple. The daughter, if over the age of 18 with no lease or rent paid, is what we lawyers call a 'licensee' and she can be removed by a court order. You can get in front of a judge within 12 days and the order can be made then. No prior 30 day or other 'notice' is required.

This is a very technical area of the law and having a lawyer is helpful. Particularly in this case, where there is a close relationship (mother/daughter!), a lawyer is very much recommended.

Verbal leases are considered month to month. Even without a formal agreement it is best to proceed through eviction. A notice to quit must be given and then if they fail to vacate, you can go to court. I offer free consultations.
