Legal Question in Family Law in Pennsylvania
Mortgage/ruined credit/remove liability
Divorced for 12 years. Contined delinquency on ex-husbands part. Mtg co.calls me for pymt. Have been 1 yr plus, concilliation ruled property go up for sale. He turned down reasonable offer. He removed for sale sign. Could not get refinanced to buy me out. Went in w/rule to show cause for contempt..judge didnt want to put him out on the street, gave him one more week to get financing. never did. I then had right to list house again. Again, although he signed realtor agreement, for sale sign delayed 2 more weeks for him to get financing. Grace period over now.
Can I demand the for sale sign go up, as ruled by judge? Mtg 1 mo. in arrears, wont agree on the portion due to me(50% of balance after mtg satisfied...was ordered by court to keep current).I cannot continue to be liable for this person's mtg. want my name off. After 1yr, this is still going on. I do not understand why he can get away with not following the court ruling. My attorney seems to feel that I should just go along with whatever stall tactics go on rather than continually go back for order to show cause. Is there something else I should be doing? Why am I in family court, this is not marital property.

Re: Mortgage/ruined credit/remove liability
If you are questioning your attorney's strategy you may want to speak with another attorney to get a second opinion. From what you told me I can't tell you if your attorney is or is not doing all he can do.
