Moving a child to a different state
My 13 year old step son's mother informed us 3 days ago she left the state and was on her way to Texas to move in with a boyfriend. This man has a criminal record. She left my step son with her mother. There is no custody order. My husband would like to get custody of his son. My husband has always been in his son's life. Please advise, if you think we will have any difficulty.

Your husband should act as soon as possible so that the mother does not file in Texas for custody. I offer free initial consultations.

As a single parent, I can understand his concerns and would act quickly. I would recommend that he take immediate action and have a custody complaint filed with the court. If the mother attempts to leave the state with the child, then a special emergency petition can be filed with the court to get the child returned.

You don't indicate your county or town. I offer family law legal counseling in Dauphin and surrounding counties. If there is no existing custody order your husband has every right to immediately exercise custody. If grandmother will not relinquish the child he should file a petition for custody. If mother has abandoned the child she will likely have a difficult time convincing a court that she should retain custody and a harder time convincing the court that she should be allowed to relocate the child to Texas.
