my son was married to a woman for 5 years they have been together for about 10 years 5 of it married she cheated and left with other man and there is no custidy papers the other man and her refuse to let our son see his daughter have not see her since she was 1 years old he works alot and dont have much money but loves his daughter can he go and just get her without permission without getting into trouble and if he was to get a lawyer do they take payments

Well your son better get on the stick and get a custody order. Until he does he won't see the child. If he trys to without an order the mom will get one and use his actions to crucify him.
If he is looking for a low cost attorney he should contact thelocal bar association.. They can refer him to a pro bono or lo bono attorney. As for paytment terms that will be up to what lwyer he gets.
The key thing is your SON has to be the driving action.
