Visatation

My exhusband and I and agreed on alternate weekend for my 12 year old son to vist him. He is remarried and has two younger children 4 and 2. Whenever it was my weekend and it fell on Christmas or Easter I let him go over to his dad's to spend the holiday with his family. Now that it is summer and memorial day is on his weekend, my son wanted to spend some of it at our camp with his friends and then the rest at his dad's. His dad is giving him a hard time and I want to know is ''does my 12 year old have a say as to when he visits him'' , his dad feels that he should give up his social life to spend with him. He wants to sign up for saturday activies but his dad will get mad that he planned something on ''his weekend''. In the divorce we have joint custody and I have physical custody. Also, my son is overweight and whenever this visiting subject comes up, my ex throw that at me that a judge will say that I am negligent,but I have been trying by taking him to weight watchers and getting him a treadmill. the only thing his dad does is make him get on scale and then tell me how much he weighs. I am willing to give so he can spend time with his dad's family but his dad will never give. Does a 12 year old have a right to say anything?

Your son is of an age that the court would give substantial weight to your sons wishes. You may wish to consider speaking with the father regarding the Saturday activities and determine his willingness to attend those activities on his weekends. I offer free consultations.
