Legal Question in Family Law in Pennsylvania

My wife walked out after 4 1/2 years of marriage and stuck me with the house we rented. There is still 6 months left on the lease, is she still responsible for half of it?

Also, the utilities were in her name because she set them up while I was busy doing the "heavy work" of packing and getting ready to move. She is now threatening to have them turned off . I contacted both the gas and electric companies and was told that since I'm over 18 and on the lease, I am responsible for the bills. I told them that's fine, but I want them transferred to my name. They told me I can't without her approval. She won't transfer them to me, she just says she will shut them off. What can I do?

Also, there's a problem with a car that she needed just over a year ago. She couldn't get financed, so the car was put in my name. The insurance was in her's. She allowed the insurance to expire without my knowledge and had an accident. She hit a telephone pole. The car is totaled, and I have been paying on it since. Is there any way I can force her to have to pay for it? It's in my name, but isn't my responsibility to pay for her carelessness.

During the divorce process, a claim may be made for equitable distribution of property, which means that you could ask the court to divide the marital assets and marital debts. The six months on the lease will likely be hard to recover if you are the person that is continuing to reside there.

The car is a different issue, you may be able to have be responsible for some of the cost, but its hard to say without knowing more facts.

I would suggest that you retain a lawyer to help assist you with this. A full consultation is really needed to determine what you are and are not entitled to.

If you would like to discuss this further, feel free to give me a call. I offer free phone consultations.
