Appeal small claims judgement

my small claims judgement was appealed in court of common pleas on 8/5/08. As of this date I have not received notice. What do I file in order to re-activate my judgement if I am not served? this is in Delaware county pa

How do you know that it was appealed on August 5, 2008 if you did not receive notice. Generally if you were the plaintiff and the other party the defendant and you obtained a verdict in your favor the other party has thirty days to appeal to the Court of Common Pleas. When they appeal they must send notice to small claims court and mail notice of appeal and rule to file a complaint on you. When you receive this you must file a complaint within 20 days of service or else your judgement in the lower court is dismissed. I suggest you contact the court in delare county to find out if the appeal was filed on 8/5/08. You can also call the small claims court in Delaware County toi see when they received notice of appeal. In any event you must act quickly or possible suffer a non pros for failure to file a complaint.
