Competitor Poses as 3rd Party, Disparages My Product

Recently I discovered an internet ''review page'' promoted via pay-per-click where they rank various products.

My product was ranked at the bottom and my competitor's product was ranked as the number 1 recommended product. Additionally, the site claims my product ranks lowest in customer reviews while not providing any sort of evidence or ranking system.

Upon researching more I discovered that this page is run by my competitor and this fact is not disclosed anywhere on the page. Instead they pose as an independent review site.

Additionally, whois information lists this individual as being in New Zealand.

What am I to do?

Develop the information and sue under various state and federal claims.

Unless you're highly skilled in legal matters you will need an attorney to represent you in this matter. S/he will know how to get the attorney general's office interested. And s/he witll best be able to sort out the stautory violations that will allow you to claim and potentially recover damages. An attorney will also know how to develop a measure of your damages so that there is a reason to bring these claims in the first place.

There are a number of possible avenues to address this situation, depending on the relief you want, or if you have been damaged.

You should consult with an attorney who can look at the site for him/herself and then determine the appropriate claims to make.
