Legal Question in Civil Litigation in Pennsylvania

WIth the death of a parent, does a child have the right to seek restitution many

My father died from 3rd degree burns to 98 percent of his body. He lived for one week before his system failed. The accident happened at Gliddon Metals in Johnstown, PA. From what I know, the shop was sited for multiple (many) safety violations. Again, from what I've been told, a spark from a metal shovel hitting a metal brush ignited an alluminum powder mix that caused the fire ball which killed my father.

My mother saw an attorney who told her she could (or should) not seek legal action. That legal action would remove all chances for workmans compensation and was too risky.

Nine months later my sister killed herself.

I'm currently in EMDR theropy in hopes of working through my childhood traumas.

My father' death occured in 1981. I was 14. Do I have legal/civil recourse?
