Defamation of Character

My boyfriend's ex-girlfriend is taking him to court for child support/custody. On the court forms she filled out that were sent to his house, she clearly stated that I ''verbally abuse'' the child, calling him ''retarded,'' and then signed it. Everyone knows and is a witness when I am around the child that I wouldn't do or say that, and never have. She has no proof that I ever did. I'm concerned about my reputation. Is it possible to sue for defamation of character or slander?

While custody filings are public record few people actual go to the Prothonotary to read them.

The protection she has against your suit is that the statements are an allegation which needs to be proven. If they aren't proved then its on record they aren't. If they are proven then they are true and truth is the perfect defense.
