Execution Sale
I was wondering if anyone could tell me what I am suppose to do or to expect in this situation. I have a Execution Sale that I have to go to in a month. I am after some money that is owed to me and this is where it has went. The person owed me $400.00. Now with all cost's, it is up to $653.00. I have a list of things that will be sold. All I was told was that I had to bid and so would the person that I did this against. It doesn't make any sense to me and I am afraid that I am going to do something that will cost me even more money. There is a car involved in the sale and I am also afraid that whatever is on the list will be ruined and won't be worth anything and I am still out money. It is a matter of moral and value's that I really went after the money to begin with. This person has been well known not to pay the people he owes but when I sold him the car, I had him sign a promissary note just for this reason. It stated right in the note that if he didn't pay, steps would be taken and he would have to pay all fee's including attorney fee's. But I have taken that direction, yet. Any information would be so helpful. Tired of trying to figure out the process myself, never done this before.

I am not a Collections Lawyer but it seems a legitimate debt is owed to you and you followed the proper legal channels to attempt to collect on it and receive your entitlement. I do not know what county you are in but I suggest you make telephone call to the courthouse and they will direct you to a person who could provide guidance on what to expect at the execution sale to put your mind at ease. You may also want to speak to a knowledgable collections lawyer about the law and procedure involved and you may even find that it is worthwhile to have his/her assistance even though a fee would probably be incurred in this matter-it probably would be contingent on any recovery you make.
