Legal Question in Civil Litigation in Pennsylvania

I am a member of a private country club. The club stores member's golf clubs on site and charges an annual fee for the service.

Recently, I went to the club, hit balls in the practice range and returned my golf clubs to the bag room attendant and instructed him to bring the bag to the parking lot because I intended to take them with me -- like most clubs, my club has a rack for golf bags outside near the parking lot. I went to the parking lot and forgot to put my clubs in the my car. My golf bag has a club issued tag with my name on it.

I went back to the club 2 weeks later and my golf bag could not be found anywhere. My club claims that they may have been stolen (but has no proof) and are denying any responsibility.

I think that they have a duty to take of property left in their care -- even if I forgot to take it away. Assuming that the club has liability, what amount of damages can I claim? Replacement cost? Value of the clubs?

At best you get the depreciated value of the clubs. That's what you no longer have not a set of new golf clubs.

However, that's if you could recover. I don't think you can. First you were negligent as well. First you forgot to take the clubs. That's on you. Second, you didn't tell anyone for 2 weeks. What you are claiming is that the club had a duty to secure clubs you had left out for you to pick up. Now you knew the pick up area wasn't being monitored. In addition someone seeing smone take a bag of clubs would seem normal.

Now maybe there should be camera monitoring the bag rack. Maybe but there isn't.

Can you sue the club sureyou can this is Pennsylvania. You can sue anybody for just about anything. That said word of the law suit is going to get out among the club members and at best it will hurt your image and you lose.
