Legal Question in Civil Litigation in Pennsylvania

I run a small business out of pa. one of my employees left a gate open at a customers property and a few hours later their dog got out. the dog was found but there is a veterinary bill. the customer refuses to pay open invoices. do i have to take responsibility for the dog? will i have a case in small claims court?

You could be liable under theory of "let the superior answer" if the breach of duty (to close the gate) was in your employee's job responsibilities. That said even if your employee left open the gate the dog owner would have to show that the gate being open was the cause of the damages. Further, what sort of injuries the dog had may affect the outcome. If the dog suffered injuries because it was shot on someone else's property the shooter could have liability as well.

As you can see it's a lot more complicated than you think.
