If you are being abused by a husband who is either a USA citizen or a lawful permanent resident (Green Card holder), you might be able to self-petition for a Green Card under the federal VAWA law.

Your children can be included into your petition, and can apply for adjustment of status.

You will need legal assistance with a VAWA self-petition. If you can't afford a lawyer, try to find a Free Legal Aid clinic in your city or ask for references through the Domestic Violence shelter.

VAWA petition is free. Applications for adjustment of status are not free, however, you might be able to ask for a fee waiver based on your inability to pay.
