Legal Question in Immigration Law in Pennsylvania

My fiance and i want to get married next year. We have been engage for almost 3 years and have 2 kids together. But he has no ssn. but does have all documents from his home country. is there any way we can get the marriage license?

Pleade do not listen to the advice above - it's a wrong and ignorant advice. Before you apply for a green card and a work authorization, you have to answer the primary question: IS he eligible for adjustment of status? What it means is whether he can apply for a Green Card through adjustment of status by petitioning the USCIS/DHS or (if not eligible) will have to go abroad to his home country to apply for an Immigrant visa.

These are two very different processes. If he goes abroad, you should keep in mind that his visa can be denied if he lived illegally in USA for over a year.

A person is generally eligible for adjustment of status (doesn't have to leave the USA) IF he came to USA lawfully on a visa and was inspected and admitted by the CBP officer (on is protected under 245i).

As to a marriage license - call the clerk of the court and ask what documents they need to see when a bride and groom apply for a marriage license. Usually, SSN is not required (but check with the courthouse).
