do you have too have a patent pending before a patent is approved by the goverment

Yes. The first step in obtaining a patent is to file a patent application. Once that is done, your application is pending, i.e., patent pending. After 2 years or so, your application will be examined and, if it is found to be novel and non-obvious, the patent application will issue as a patent.
