collecting pay for unused vacation time

A friend of mine is leaving her position at the end of this week. She will start her new job on Monday, 5-8-00. She has about 2 or 3 weeks of vacation time accumulated. Due to the start date of her new job, she was unable to take the vacation time she earned. Her boss says that he is not obligated to pay my friend for the vacation time she earned. I have worked three different places in my life and have received compensation by all three businesses for unused vacation time. My last employer told me that she had to pay me for my unused vacation as this is the state law. Does my friend have any legal recourse???

Yes.

Your friend should contact a lawyer or the Pa. Department of Labor. Benefits that are already earned must be paid when the employment relationship ends. The Pennsylvania Wage Payment & Collection Law provides a right to sue for the benefits as well as liquidated damages and counsel fees.
