Legal Question in Employment Law in Pennsylvania

Non-payment for services rendered

I was hired to do a project for a non-profit theatre in PA. I completed the project but have not been paid. The current word at the theatre is that the treasurer is refusing to pay all invoices submitted. Do I go through small claims court for payment? How do I get the money owed? The total amount contracted for is $1250, I have a contract (signed in March), work was completed July 3 and payment promised July 9, 2004.

Re: Non-payment for services rendered

We do not practice in PA, so I cannot really advise about your specific legal rights there. However, I would suggest that before you avail yourself of hte Courts you attempt to resolve it with them directly first. I would suggest aht you contact the president or chariman of the theater company regarding the situation. The problem may be cash flow for a not-for-profit company. Perhaps they are waiting for opening or ticket sales? In any case, communication is important. Keep in mind, that unless they have some type of assets, you may be unable ot collect. (Cannot get blood from a stone). Thus, before you go through the Courts, try to further assess the situation and arrange payment. If not, you probably can file a claim in Small Claims Court. Usually, the Courts will have all the insttructions necessary for you to pursue this type of claim.
