Legal Question in Employment Law in Pennsylvania

I signed a non compete with my former employer and then took a position with a competitor. I received a letter stating that I should quit my new job within 5 days. Are they legally allowed to make me quit my job?

Before I respond to your inquiry, I must state that we have not spoken, I have not reviewed the relevant documents and facts, and I do not represent you. Therefore, my discussion below is not a legal opinion, but is informational only. Finally, my discussion applies only to issues to which Pennsylvania or Federal law apply, unless otherwise specified.

That being said, the quick response is no, your former employer is not legally allowed to tell you to quit your job. Nor can they tell your new employer to fire you. However, they can take legal action to enforce your non-compete clause including filing actions in court. You should speak with an attorney who will be able to review your situation, including your prior non-compete and you job position at your former job and at your current job.
