Legal Question in Employment Law in Pennsylvania

Unequal comp time policies

I work in a small consulting firm. I am one of only two salaried employees. The other salaried employee is given 8 plus days off a year/paid/called comp time. I requested the same (actually asked for 6 days, not 8) and my request for comp time was denied. Is this discrimination? Can a company legally have different practices for their employees? Can I pursue this legally?

Re: Unequal comp time policies

Under the laws of most states, employers are free to discriminate between employees as long as the discrimination is not based upon a protected category such as race, gender, religion, age, etc. If you believe that you are being treated differently because of one of those categories you may have a legal remedy. If the different treatment is not tied to a protected class, however, the law will allow an employer to give some employees more favorable treatment.
