Legal Question in Employment Law in Pennsylvania

Re: Equal Pay

I have worked for my current employer as a part-time RN for the past 2 years. We are a small business with 10 employees. Two weeks ago, a full-time RN was hired at a pay of $5.00 more an hour than what I am making. I have not had a raise in the two years working at this business. I am a good employee in good standing. Do I have any rights? Thank you for your reply

Re: Re: Equal Pay

Probably not. Unless you have some sort of agreement (contract) with your employer your employer can pay you anything (as long it is minimum wage) your employer wants. Your employer is able to pay different people different rates even though it may not be fair.

The exception to this however, is when your employer is paying someone lower because of some illegal reason. For example, if all of the women are paid lower than the men then this would not be legal. That is why I initially answered this question as probably not. I don't have enough information about who else is being paid what. Nor do I know the makeup of the other employees (race, sex, etc.)

I hope this helps. If you want to call me and talk further please feel free to call me.

Sincerely,
