Legal Question in Employment Law in Pennsylvania

Employment offer

I was offered a job at another company and verbally accepted. HR said they would send out the offer letter with benefits info. in a day or so. If I give my notice before I receive the offer letter and the hiring company decides to change their mind do I have any kind of legal rights?

I agree generally with the reply of Richard O'Neil. However, if the offer of employment was for a specific period of time, Pa courts will enforce the agreement even if it is only verbal. Also, you may be able to recover for the damages you sustained when they breached their promise to employ you, i.e. the loss of your current job. I woul urge you to contact an attorney promptly to get a full review of the situation and your rights.

Pennsylvania is an at will state. That means an employer can terminate you at any time provided they don't violate an employment contract, union bargaining agreement or have some illegal reason for terminating you. Therefore, an employer can hire you one day and fire you the next. This is pretty much the solid rule.

However, there have been cases in which a person has quit their previous job, moved to the new company and then been fired shortly thereafter and that person has a right to recover against the new employer. It doesn't happen very often, but if you put out a lot for your new employer you might have the right to sue them if they terminate you very quickly after being hired.

You should try to get everything in writing if you can. Because if something does go wrong you will be in a better position if you have names, dates, and notes about to whom you have spoken to about the new position.
