Legal Question in Employment Law in Pennsylvania

Withheld final pay

My former employer said he would send me my final paycheck and commission check two weeks after firing me. He only sent me about 1/4 what was due to me. I called him to ask him where the rest of my money was and he said that was all I was owed and hung up on me. Do I have any recourse?

Re: Withheld final pay

You asked if you had any remedies where an employer has failed to pay you in full.

You have at least two options, the first being to use the state department of labor. File a complaint with them and they will investigate the matter. They are very thorough but will get to the bottom. If the find the employer violated the law it will also be subject to a potential fine. You may also proceed against the employer in court and I believe, if you prevail, the statute allows you to also collect attorney fees.

But proceed with the state complaint option first.
