Legal Question in Landlord & Tenant Law in Pennsylvania
renting without a lease
I moved may 19 2007 to a new home. I gave my landlord 30 day notice. I received a letter dated July30, 2007 that I damaged this property and that if I don't pay him 6,631.48 in damages that he's taking me to the authorities. First some of the damages were there when I moved in and some of the damages are spill stain on cement can he really sue me??

Re: renting without a lease
Actually he has to refund your security deposit.
A landlord has 30 days upon taking possession of the premises to either give you a bill for damages that equals or exceeds the security deposit. Or give you a bill that doesn't exceed the security deposit and send you the difference. Or refund your entire security deposit.
His letter is too late. That said you may sue him for the security deposit however, do not sue for double your security deposit. If you do he get the chance to bring up his damages even though more than 30 days has past.
