security deposit

my son and his girlfriend signd a lease and just put a security deposit down. his girlfriend and him broke up and neither one will be moving into this appartment on 8/1/06/ the first months rent was not paid yet, does the landlord have the right to keep that deposit.

The landlord also has the right to continue to collect the monthly rent until the apartment is rented, up to the full term of the lease.

In other words, the landlord can require payment of the amount of the monthly rent for every month that he is unable to rent the apartment. However, the landlord does have to make an effort to rent the apartment...advertise, show the apartment, etc.
