Re: Security Deposit

First, did you notify your landlord of your new address? If you haven't you may not get your deposit back in the required 30 days.

Second, Have you even contacted your landlord about the matter? If you haven't given him an address that would be a good time to tell him. The law doesn't require him to track you down. It requires YOU to tell him where to send the check.

If you have told and its been longer than 30 days you can go to the DJ and sue him for the deposit and the cost of filing with the DJ. You actually can sue him for twice the security deposit BUT if you do he can raise a claim of damages that may well exceed your security deposit. Further, because you didn't do a walk through you have no evidence to dispute his claim and he's likely to have pictures

Bottom line talk to the landlord first if he doesn't have a list of damages or your deposit then you can see the DJ.

Remember talking is cheaper and faster than suing everyday of the week and twice on Sundays.

If you have any questions feel free to contact me. The initial consultation is free.
