Terminating A Lease Early

I have a tennant that can't pay rent. I wish to get her out w/o eviction. Her lease ends in about 9 months. She agreed that she would like to move out. I also would like her to move out. Is it acceptable to get her to sign some sort of document that both parties agree to end the lease on June 30th? I figure this is an alternative to evicting her. She can no longer afford the rent. There are no guidelines in the current lease about lease termination; according to the lease she only could be evicted if she violates the lease. So my first question is ''Can we terminate the lease early if both party's agree?'' What is the proper procedure to do this? What if she doesn't leave after lease termination? Then how can I get rid of her?

If both parties agree you can create a lease addendum which would modify the terms of the lease to change the termination date. I offer free consultations.

You can always modify a contract by agreeing on new terms. Thus, you can certainly agree with her to end the arrangement on a date earlier than the end of the lease. If she doesn't leave after the lease termination, then you will have to go through eviction procedure.
