Legal Question in Legal Ethics in Pennsylvania

I signed an employee contract in 2009 as an outpatient mental health therapist. The contract states that it is automatically continued each year. Contract says I will not take a position as an outpatient counselor at another company within 10 miles of current company. I would like to change jobs. Can my company hold me to this contract?

Your employer may have a good case against you. A restrictive covenant, if supported by consideration will generally be upheld so long as the geographic limitations, and the length of time that the restriction lasts, are determined to be reasonable a court. The real issue depends on the language of the contract itself. Before making any move, I think that you should consult a lawyer and have read the contract. If the restrictive covenant is upheld, you could be liable for a large amount of money, and may be prevented from working at your new job.
