Legal Question in Medical Malpractice in Pennsylvania

I had reconstructive surgery to my right ankle on 8/3/06. The doctor told me I had to have my ligaments repaired as well as my tendons. He told me that he also had to lower the arch in my foot so it did not ruin the work he did. One day after the surgery I had a high fever and my wife called the doctor and told them and they said it was common. One month went by and discovered I had a double staph infection that caused me to lose wieght and be depressed from pain meds and antibiotics and now I am having more trouble and he told me I have to have the screw removed from my foot to see if it will help the pain I am having. Is this negligence in anyway?

The real question is, assuming there was malpractice, is your case worth pursuing. Presenting a med mal claim is very expensive. Most experienced med mal attorneys, including me, will not become involved unless the med mal caused a very significant injury such that a substantial jury verdict, of at least $500,000, could be expected. Unless you end up with a permament problem caused by the med mal, it's likely not worth pursuing. That said, you should consult with an experienced med mal attorney in your local area.
