My 26 year daughter made a mistake when she was 19. She went through the ''normal'' court proceedings, was put on probation, and was following all the rules as set. This happened in 1997. Her probation was being monitored by the County Probation Office where she lived for the two counties involved. Her probation was and restitution was completed in 2000/2001 for the one county and closed out by her probation officer. She is still paying restitution in the other. On January 2, 2003, two state constables came to her home , cuffed her, and took her to jail located in one of the other counties. She lives on half of a heart due to congential heart defects and open heart surgery at ten years old. She must take heart medication daily. She was held for five days due to an mistake on the state's computer system and they detained her. In these 5 days she was not allowed her heart meds, not treated for her condition and lost 10 lbs. from throwing up all foods that she was given. During the weekend, we were able to reach her probation officer that handled the computer mistake on Monday. A friend who is an attorney and a District Justice tried to help by calling the jail regarding her condition. Does she have any recourse?

yes, but you need to establish damages, did her condition become permanentlyu worse, is she psychologically damaged?
