Legal Question in Personal Injury in Pennsylvania

Hello All,

I received a letter from a law firm today that says they represent my insurance company reference an accident I was involved in, but am not liable. Someone ran into the back of me. The letter is basically asking me to contact them in reference to trying to recover damages they (my insurance company) paid to me on the liable insurance company's behalf. My question is, what exactly are they trying to recover? It states in parenthesis including any unreimbursed deductible. In our policy we had out of work coverage for one year, as well as the coverage that reimburses me for all of my medical bills. Are they trying to recover that money? ie. medical reimbursement, out of work pay, and the deductible. Why are they asking me for my help? It says they may have to file suit against the liable insurance company to recover the damages and my help is crucial in helping them with that. Please explain to me why my help is needed. It also says TO NOTE in bold and underlined, that they are not able to help me collect any out of pocket expenses and they are NOT MY ATTORNEY. But they want my help. So sorry this is long and I hope it makes sense. If not please feel free to ask me any questions that may better assist you in answering my questions.

The insurance company paid to fix your car. They are seeking that money that was paid to fix your car, from the responsible party. This process is called "subrogation"

You ask why they need your help. Well, you are the one who was in the accident, you are the witness. How do they prove a case without you? You are crucial to the case. Further, I guarantee that you have a responsibility to help them. I am certain that your insurance contract says that you must help them to recover any damages that are paid on your behalf.

At a minimum, they want a statement from you. That may be enough, but you won't find out until you contact them.

To the above, I would add that the insurance company's law firm wants to collect from the other party everything your insurance company spent on you so this includes, per your description, medical reimbursement and out of work pay. They also will include a claim for your deductible for you. Everything you describe sounds completely normal.
