What amount should you sue for?

A pedestrian was hit by a car in a shopping mall parking lot. Medical bills range in the $7-9,000.00 range as of this day. The pedestrian has permanent nerve damage in one leg, significant scarring and atrophy. There was a fracture that has now healed. Pedestrian is unable to remain on legs for long periods of time so can only hold a desk job. The pedestrian is covered to sue for pain and suffering. What monetary range are we looking at to sue for?

First of all, this case is too serious to proceed without an attorney. The first step is to gather supporting documents such as the police report and medical records/bills. You would then set up a no-fault claim to get those bills paid up to the policy amount. Then you would set up the claim with the liability insurance adjuster, get them to accept liability, and attempt to negotiate a settlement. If, after a reasonable period of time, you cannot reach agreement, you would then file suit in the Court of Common Pleas.

You don't sue for a specific number. In this case, it sounds like you would not need to go through mandatory arbitration, as this case is likely worth more than fifty thousand dollars. So, you would file as a major trial, simply demanding in excess of fifty thousand, and the litigation process goes on from there.

It is not possible to answer this question ih any true and professional manner as the value of a case is determined by a number opf factors. Fot exam[ple, where the event happened, the venue of the law suit, the liability aspect, the age of the plaintiff, work history, acitvity levels and so forth Please hire a professional who specializes in these cases.
