Legal Question in Personal Injury in Pennsylvania

Daughter killed by suv

MY DAUGHTER WAS STRUCK AND KILLED BY NA SUV WHILE WALKING ACROSS A STREET AFTER HAVING A FEW DRINKS. HER BLOOD TEST SHOWED A 0.10% THE ACCIDENT OCCURED AT 2:22 AM AND SHE WAS PRONOUNCED DEAD AT 8AM THEY TOOK BLOOD 4HRE BEFOR HER DEATH. NOW I HAVE FUNERAL BILLS TOTALING 15,000. AND NO WAY TO PAY THEM. CAN I SUE THE BARS THAT SHE WAS IN JUST MINUTES BEFOR THE ACCIDENT? THE POLICE REPORT STATES THAT THE MANAGER OF tgi FRIDAYS SAYS HE DID EVERYTHING IN HIS POWER TO KEEP HER FROM LEAVING . AND WANTED TO CROSS HER AND SHE DECLINED THE OFFER.

In Pennsylvania you may have an action against a bar who serves someone who is "visibly intoxicated". These cases are difficult but it sounds as though the manager has made statements which could help prove intoxication. If her blood alcohol was measured 2 hours after the incident her blood alcohol at the time of the incident may have been higher, which could suggest that she was visibly intoxicated before being served her last drink. There is also the possibility of an action against the driver. More information is obviously needed to determine if either action is warranted.
