injury not taken care of in jail

my boyfriend broke his ankle prior to going to prison. the doctor they sent him to was going to operate to fix the problem but the jail waited too long to take him back to the doctor and he now says that there is nothing that can be done to fix the problem. now has trouble walking, pain in ankle and foot, and swelling. he is also diabetic in which the foot trouble is a potential problem

if your facts are correct, he has a potential case. why is he in prison?
