Legal Question in Personal Injury in Pennsylvania
parental compensation for pain & suffering, mental anguish
our 5 year son was seriously injured at a construction site at our home, his foot was partially amputated when he fell through large pile of glass left laying on ground for several days. horrific accident was witnessed by parent. son severed major arteries and bled prefusely. insurance now wants to settle for medical expenses.
Question: is parent entitled to compensation for mental pain and anguish?
Second question, would this be listed under construction law or personal injury?
so far no papers have been signed with attorney

I am SO sorry to hear about your son. I don't have kids, I can not imagine how upsetting that must have been!
Do NOT sign anything until you have all the facts reviewed by an attorney! This is a construction accident case resulting in personal injury. There are attys around with the proper construction background to handle this.
There are a LOT of factors to consider, were there proper barricaides up, who left the glass, who was responsible for cleaning up the glass, was it an attractive nusiance, how did the child get there, who was aware of the debris, will he have ongoing medical needs and costs, etc., etc.
Most likely, the child will be entitled to additional monies, and the parent(s) may be entitled to damages also.

I am very sorry about your son's injury. I am sure you & the rest of your family are also suffering. Yes, those who witnessed the incident may also recover. Do NOT settle with the insurance company until you talk to an attorney. If you settle you might be giving away some of your and your son's rights. This is a personal injury claim.

I am SO sorry to hear about your son. I have 3 young children of my own.
DO NOT sign anything and do not settle out with any insurance company until you and
your son are fully compensated. The insurance companies only want to protect their interests and not you or your son�s interests. The insurance companies have lawyers and so should you! This case appears to have significant value!! You and your son are entitled to a lot more than just his medical bills, including but not limited to past, present and future pain and suffering and the loss of life�s pleasures and activities. Most insurance polices have a medical bill provision in addition to liability coverage - I use to work with insurance companies in defending these claims but not any more, my personal injury practice is now limited to only representing families like yours. This is a personal injury case with construction issues with potentially great value - the insurance company knows this and sounds like they are selling you short!
