slips and falls
Fell in a supermarket parking lot on a rather large pothole that was covered by snow slush. I fell to my knees; I did not go down lightly as I am a large lady. The clerk did fill out an injury report at the store the clerk, at that time I declined medical attention. The next day upon waking my body was sore and stiff and my knee became locked up twice while getting out of bed and dressed. I reported to the local ER, where some x-rays were completed. Nothing showed up on the x-rays with the bone, but the doctor said he thought I had some torn tendons/ ligaments and a flapper issue since my knee was getting locked. He said I should see an orthopedic doctor to have an MRI to reveal the injuries and surgery may be needed to repair any damage especially since my knee was getting stuck. I have an ortho appt upcoming. I called the supermarket to let them know. She said she was not able to find the injury report and asked me who filled it out I gave her the clerks name and she said she would need to call him. She also said to keep them informed of the medical treatment needed I also mentioned the possible MRI. She did not mention anything about payment. I gave the ER my medical insurance but will I be out all the money for my co pays?

Do not communicate with the supermarket or its insurance company. Hire an experienced personal injury lawyer to do your talking for you. The supermarket and it's insurance company are experts at minimizing the amount of money they pay to victims. An experienced personal injury lawyer will know how to handle them. The supermarket or its insurance company should pay for all of your medical treatment, wage loss, and pain and suffering.

I would recommend that you retain an attorney who should immediatley send a letter to the store and put them on notice again of the accident, describing the circumstances of the fall the person you spoke to and the fact that a report was taken.
As for your medical bills, at the end of your treatment, any out of pocket medical bills would be submitted to the store's insurance carrier, along with a demand for settlement, which would include your pain and suffering. If you have any photos of the pothole, that would be great.
I would not recommend you having further contact with the store, and definitely not its insurance carrier, who may call you for a recorded statement that you are not required to give.

It is not uncommon for the owner of th lot to give you a difficult time. You need to go after them aggressively. You should hire an attorney and get all the money that you deserve.
