Legal Question in Personal Injury in Pennsylvania

small group responsibilities

Three of us homeschool moms have organized a play day once a month at our church. I copied a standard waiver from my son's basketball org. and I plan to have everyone who comes sign one. Are we three moms liable if someone gets hurt? What about the church. I named the church and we three moms in the waiver. We call the group the Homeschool Kids. Can I put that name on a flyer to let people know when we meet? Do I need to register that name? Does that cost money? Thanks in advance.

Re: small group responsibilities

you raise alot of issues. the first thing that I notice is that it is never wise to copy another's waiver and assume that it will protect you. I dont know who drafted it or what type of language it contains or whether it is even suited for your purposes. a waiver is only going to apply to certain circumstances. if a child gets hurt because of your negligence, or the negligence of another mom or the church, the waiver may not have any effect even if it is well drafted. the next thing that I am concerned with is who is coming? are there children other than the children of the three moms? what are their ages? you can run into problems if you dont have enough adult supervision for the number of children present, i.e. 3 parents and 600 children. as far as having a name and printing a flyer, i dont foresee any problem with that and I dont see the need to register a name. you should probably consult with an attorney in your area because you have raised a number of questions.
