Legal Question in Real Estate Law in Pennsylvania

Boat Dock on easement property

I have a boat dock that has been on a land easement for over 30 years. A new neighbor bought the adjoining lakefront property and now want the dock removed (dock does not go on his property or lack access). Dock was properly permited, but person permitted has died and state lost paperwork. State only has a record that lock was permitted, nothing else). New landowner has gone to state and wants dock removed. State wants new permit to be filed.

All of the original land owners are deceased and property titles show easement, but do not state "docks are allowed".

What are my legal positions?

Thanks

Re: Boat Dock on easement property

If the dock was there for over 21 years there is probably a perscriptive use depending whose land it's on. Does state own lake? If easement is on file what is easement for? More information is needed. The death's of former owners may not be that important. You need to see a lawyer near you, who has knowledge of real estate. Nice neighbor
