Legal Question in Real Estate Law in Pennsylvania
My father cosigned for a auto loan for my brother. My brother failed to make payments and voluntarily turned the vehicle back to the bank. He owed 17,000 and they auctioned it for 15,000. There is currently a lien against my fathers home until the balance is paid. My brother was making arranged payments on the balance but recently has decided to file chapter 7 bankruptcy. We are under the impression that the balance now falls on my father. What does he have to do in order to have this lien lifted from his home? We would like to have the house transferred to my name.

Your father has to pay the balance. It seems like a small amount, though. I'd try to work something out directly with the bank.
