Legal Question in Social Security Law in Pennsylvania

My son is two years old, his biological father (who does not live with us and is married to another woman) will begin getting SSI in September 2008; I understand that minor children can collect SSI, will my son be able to collect also

First, it seems odd that he will not be getting his benefit until Sept. 2008 if he is disabled now.

SSI is a welfare program for disabled people and there is no auxiliary children's benefit.

However, if the man worked and paid FICA, the Social Security tax, then he should be getting a Disability Insurance benefit - not SSI. That program does provide a benefit for minor children. The benefit is payable to the custodial parent and you need to contact your local SSA office to file a claim for your child.
