death without a will

My father passed away Monday and he had no will. since there is no will my thoughts were no one was in charge of his assets until it went to probate . there are 6 kids and the 3 oldest has decided what to do with all dads assets. for the last 3 months that my dad was sick I drove his truck .he died monday and on wednesday my sister took the truck from me and stated she was in charge she is the oldest and I have no say. my father and i jointly owed my home and now they are putting it up for sale. do they have that right. their thinking is they want everything out of his name. I cant afford a new mortgage right now . any advice. thanks

I'd tell sister not so fast. The disposition of your father's estate is controlled by statute. An intestate estate would make all 6 of you entitled to 1/6 of the estate assuming your dad was not married at the time of death.

You can file with the court for letters of administration. Actually somebody must as there are tax forms to be filed and taxes paid.
