My Grandfathers Will?

My grandfather passed away in december 2006, my mother to complete care of him and now 2 of my 4 aunts are taking my mother to court to have the will probated? what exactly does this mean and is there a time period in any funds left to children have to be given out? Also my grandfather passed away in Pa and my aunts live in Fl if that makes any difference

If your grandfather had a will, the will should be probated [filed with the Register of Wills Office] in the County where he resided at the time of his death.

If your mother has the Will, your aunts may be seeking to require your mother to file the Will.

The estate of your grandfather must be formally administered, with certain steps being taken before the proceeds of the estate are distributed to beneficiaries in the will or heirs who are entitled under the law to make a claim contesting the will.

All heirs and beneficiaries must receive a notice when the will has been filed, so that they have the opportunity to make a claim or to contest the will, and they are also entitled to an accounting of what was in the estate at the time of death, what expenses were paid out of the estate, and what, if anything, remains to be distributed to heirs and/or beneficiaries.

Your mother should consult an estates lawyer in the County where your grandfather resided to assist her, if she does not feel able to handle the estate administration on her own.
