Legal Question in Wills and Trusts in Pennsylvania

power of attorney

My uncle died 3 years ago in Pa. My aunt may be Power of Attorney(his and my mother's sister.)How do we get her to give up the funds he has for my mom and us?I know my aunt (married to a retired Navy Captain) is greedy and dominating things here. I checked it out with the county he died in and there's no will which is odd for a successful insurance agent like my uncle. I live in Philly, Pa. and have been to the Media courthouse where the tax revenue service gave me copies of taxes that were paid and leftover monies were given to his one ex-wife and his four children.

MY mother and uncle were close and there's no way I'm going to believe, as poor as she was, that he left her nothing. My cousin (his son)said at the funeral that I was ''set for life'', but then I was confused. Now, 3 years later, my aunt is sending mom checks for $500 at random which my mother always accepts and doesn't question. I'd like to investigate this further but am on disability myself and have no money. Is she legally responsible for letting us know or can she control this from her end? Is there a time factor here? Can I hire a lawyer to find out? Thanks. 08/12/07

The facts you give are somewhat complicated if he left no will and had no wife at the time of his death all probate assets wouls go to his children. If he had assets in trust or non probate assets they may have been left to others. You or your mother should make an appointment with an attorney to discuss this further to see if there is something furthet that may be done. it seems strange that your mother is getting $500.00 without an explanation as to the source of the funds.
