Statute of limitations

Is there a statute of limitations when a spouse dies for how long you have to switch over any estate? Would the courts appoint a legal guardian for a minor of the deceased if he still has a living parent that is capable of being his guardian?

As to question #2 probably not, unless there is a defect with the parent (ie- mental or physical disability or addiction), as to question #1, the assets of the deceased need to be probated unless they are of insignificant worth, but there is still procedure that must be followed.
